Example 1
The court hereby delivers the sentence.
The defendant, Yoon Jihun, is sentenced to life imprisonment.
The defendant, as the eldest son of the victim Yoon ○○, had been subjected to long-term physical assault and abuse by the victim, and was assaulted again by the victim on the afternoon of the day of the crime.
At approximately 3:00 AM that same day, the defendant, in a moment of sudden rage, inflicted a fatal wound upon the victim, resulting in the victim's immediate death.
The defendant's younger sister, Yoon Sumin, discovered the incident immediately and reported it to the police. The defendant did not flee the scene or attempt to conceal the crime, but remained at the scene and complied with the police arrest.
The court takes into account as favorable circumstances that the defendant was driven to the crime by long-term domestic violence, that the crime does not appear to have been premeditated, and that the defendant did not attempt to flee or destroy evidence after the crime.
However, the defendant violated the victim's right to life, resulting in death, and given that the victim was the defendant's immediate progenitor, the gravity of the crime is by no means light. Accordingly, the court sentences the defendant to life imprisonment.
